ARTICLE 1 — PARTIES

BUYER
The name and surname, address, e-mail and telephone details entered by the BUYER when placing the order; this information forms an integral part of the contract.

ARTICLE 3 — PRODUCTS AND DELIVERY TIME

The name, quantity and VAT-inclusive price of the ordered products and the delivery time for each product are shown in the order summary and in the copy of the contract sent to you. Applicable delivery times:

• In-stock products: Approximately 2 weeks (10-14 working days)
• Made to order: Approximately 6-7 weeks (30-35 working days)
• Products subject to stock confirmation: Determined according to stock availability; the delivery time is notified separately with the order confirmation, and production/shipment does not begin without your approval

ARTICLE 2 — SUBJECT AND SCOPE

This contract governs the rights and obligations of the parties, in accordance with the provisions of Turkish Consumer Protection Law No. 6502 and the Regulation on Distance Contracts, with respect to the sale and delivery of the products ordered electronically by the BUYER via the website at https://selishome.com belonging to the SELLER, the characteristics and sales price of which are specified in the order summary and in the Pre-Contractual Information Form.

The BUYER acknowledges that, before approving this contract, they have read the Pre-Contractual Information Form and have been informed of the essential characteristics of the product, the VAT-inclusive sales price, the payment and delivery terms and the right of withdrawal.

ARTICLE 4 — DELIVERY TERMS

The delivery time varies according to the product type and is also shown separately for each product in the table above. By approving the order, the BUYER declares that these time periods have been notified to them and that they accept them.

Time periods begin to run from the date on which the order and the payment reach the SELLER. Delays that may arise from official holidays, extraordinary weather conditions and logistical reasons beyond the SELLER's control shall be notified to the BUYER immediately.

• Before delivery, the transport team calls the BUYER by telephone to confirm the delivery appointment.
• If the BUYER is not present at the address at the agreed appointment, the resulting redelivery cost shall be borne by the BUYER.
• Requests to change the delivery address must be sent in writing to [email protected] before the product is dispatched.
• In buildings without a lift, carrying is performed up to the 3rd floor, provided that the staircase is suitable. If an external furniture lift or additional equipment is required, the cost of this service shall be borne by the BUYER; upon request, the SELLER will arrange it.
• For deliveries within Türkiye, the shipping cost for orders of 80,000 ₺ and above is borne by the SELLER. For orders below this amount, the shipping cost is shown separately in the order summary.
• The assembly service is provided free of charge by the SELLER's own team for all products that require assembly.
• For European door-to-door deliveries (Germany, the Netherlands, Austria, Belgium, France, Switzerland, Bulgaria), the door-to-door shipping cost is included in the product prices; no separate shipping fee is charged. The included amount is calculated in euros based on the products in the basket and converted into Turkish lira at the foreign exchange selling rate of the Central Bank of the Republic of Türkiye (CBRT). For deliveries to other European countries and to Georgia, the shipping cost is not included in the order amount; the estimated shipping cost (Estimated shipping: ~200 € per m³ — please contact us for the exact shipping fee.) is shown in the order summary for information purposes only, and the exact shipping cost is notified separately to the BUYER after the order. For deliveries to other countries, the shipping time and cost are notified separately to the BUYER after the order. The free shipping threshold does not apply to deliveries abroad.
• To cover exchange-rate risk, a margin of 1.5% is applied to the foreign exchange selling rate of the Central Bank of the Republic of Türkiye (CBRT) in currency conversions: foreign-currency equivalents of Turkish lira amounts are calculated at this rate less 1.5%, and the Turkish lira equivalent of shipping costs set in euros at this rate plus 1.5%.

ARTICLE 5 — DAMAGE AND INSPECTION ON DELIVERY

• The SELLER is responsible for damage occurring during transport.
• If the BUYER detects damage at the time of delivery, they must add the note “received damaged” to the delivery report and notify the SELLER, together with photographs, within 24 hours.
• Where damage is reported, the product is replaced, repaired or its price refunded; the shipping costs of these operations are borne by the SELLER.

ARTICLE 6 — RIGHT OF WITHDRAWAL

The BUYER has the right to withdraw from the contract within 14 (fourteen) days from the date of receipt of the product, without giving any reason and without paying any penalty. The right of withdrawal may also be exercised during the period from the conclusion of the contract until the delivery of the goods.

The SELLER shall refund all payments received, including delivery costs, within 14 days from the date on which the notice of withdrawal reaches it.

• The product to be returned must be unused and in its original packaging; its accessories and documents must be complete.
• It is sufficient to send your notice of withdrawal within 14 days; you are not obliged to send the product back within this period.
• 🔑 Return shipping costs are borne by the SELLER. Pursuant to Article 12 of the Regulation on Distance Contracts, no return costs are charged to the BUYER when the return is sent with the carrier designated by the SELLER for the return. If the designated carrier does not operate in the BUYER's region, the SELLER organises the transport and bears its cost. Only if the BUYER ships the product with a different carrier of their own choosing is the cost of that shipment borne by the BUYER.

ARTICLE 7 — CASES IN WHICH THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED

Pursuant to Article 15 of the Regulation on Distance Contracts, the right of withdrawal cannot be exercised in the following cases:

• Products prepared in accordance with the BUYER's requests or personal needs and manufactured to custom dimensions or design. (Choosing one of the colour or fabric options of a standard model in the catalogue does not make the product personalised; the right of withdrawal applies to these products.)
• Products which, according to the product introduction and user manual, are to be assembled by the SELLER or its authorised service, once assembly has been completed. If you wish to exercise your right of withdrawal, you must give notice before signing the assembly report.
• Products whose packaging has been opened after delivery and whose return is unsuitable for health and hygiene reasons (mattress, mattress pad, pillow, etc.).

ARTICLE 8 — ORDER CANCELLATION AND PRODUCTION DEDUCTION

For made-to-order products, no deduction is applied to cancellations made before production begins, and the full amount paid is refunded.

If the BUYER cancels the order after production has begun, the SELLER reserves the right to apply a deduction of 60% of the order price to cover the production costs incurred. The remaining amount is refunded to the BUYER within 14 working days from the approval of the cancellation.

This article does not eliminate the BUYER's right of withdrawal arising from the Regulation on Distance Contracts. Where the right of withdrawal is exercised, the provisions of ARTICLE 6 apply.

ARTICLE 9 — WARRANTY AND DEFECTIVE GOODS

• The products are covered by a 2 (two)-year warranty; the warranty period begins on the date on which the product is delivered to the BUYER.
• The warranty covers material and workmanship defects arising from manufacture. Misuse, impact, improper cleaning and assembly carried out by unauthorised persons are excluded from its scope.
• In the case of defective goods, the BUYER may exercise, at their choice, any of the following rights: free repair, replacement of the product with a new one, price reduction or rescission of the contract.
• Liability arising from defective goods is subject to a 2-year limitation period from the date of delivery of the goods.

ARTICLE 10 — PROTECTION OF PERSONAL DATA

The BUYER's personal data are processed by SELİS KOLTUK MOBİLYA İTHALAT İHRACAT SANAYİ VE TİCARET ANONİM ŞİRKETİ in its capacity as data controller within the scope of Turkish Personal Data Protection Law No. 6698. For the data processed, the purposes of processing, the parties to whom data are transferred and your rights, you may review the Privacy Notice at https://selishome.com/kvkk.

ARTICLE 11 — DISPUTE RESOLUTION

For disputes that may arise from this contract, the Consumer Arbitration Committees and Consumer Courts at the BUYER's place of residence or at the place where the transaction was carried out have jurisdiction, within the monetary limits announced each year by the Ministry of Trade.

ARTICLE 12 — ENTRY INTO FORCE

By completing the order process, the BUYER declares that they have read, understood and accepted this contract and the Pre-Contractual Information Form. The contract is deemed concluded at the moment of this approval, and a copy of it is sent to the BUYER's e-mail address.
